Terms and Conditions
These terms and conditions (“Terms and Conditions”) together with information published on the visitTeesvalley website www.faceofteesvalley.co.uk “Guidance Notes”, are the Competition Rules ("Rules") and apply to the competition known as “The Face of Tees Valley” ("Competition"), unless otherwise expressly stated. By entering the Competition, entrants agree to be bound by these Rules.
In cases of inconsistency (between the Terms and Conditions and Guidance Notes), the Terms and Conditions shall prevail.
The Competition is organised by “The Bgroup (UK) Limited” of Keel House, Garth Heads, Newcastle upon Tyne, NE1 2JE (company no. 04250784) on behalf of “Visit Tees Valley” of Melrose House, Melrose Street, Middlesbrough, TS1 2XF. Hereinafter both parties shall be referred to as the “Promoters”.
The Promoters reserve the right to cancel or amend the Competition or these Rules at any time without prior notice. Any changes will be posted within these Rules. A copy of the Rules may also be obtained by sending a stamped addressed envelope to: Competition Rules, visitTeesvalley, Melrose House, Melrose Street, Middlesbrough, Tees Valley TS1 2XF.
In the event of any dispute regarding the Rules, conduct, results and all other matters relating to the Competition, the decision of the Promoters shall be final and no correspondence or discussion shall be entered into.
Entry to the competition requires no payment to be made from entrant to the Promoters.
Qualifying Entrants
To qualify to enter the Competition you must be aged 18 or over.
To qualify to enter the Competition you must normally reside at a UK address within the Tees Valley (postcodes within Darlington, Hartlepool, Middlesbrough, Stockton-on-Tees and Redcar & Cleveland). Successful applicants will need to provide their proof of residency e.g. with a utility bill with their current address and name.
Employees of the Promoters or members of their families or households, are not eligible to enter the Competition.
The Promoters reserve the right to verify the eligibility of all entrants.
Additional eligibility requirements shall apply and may be considered at any stage of the Competition. Accordingly entrants may be required to demonstrate that they:
- Have never been convicted of a criminal offence which would cast serious doubts as to their character in the mind of a reasonable person by consenting to enhanced CRB disclosure;
- Hold a driving license or passport that is valid in the UK;
- Can provide acceptable written consent to allow a child under the age of 16 participate within the Competition;
- Have no medical condition which shall prevent them from participating within the Competition without putting their own or someone else’s health at risk by consenting to an independent medical examination and/or consenting to the release of medical records;
- Have adequate IT skills to enable them to complete any tasks the Promoters may deem necessary.
By entering the Competition, you hereby warrant that all information submitted by you is true, current and complete.
The Promoters assume that by entering the Competition (and you warrant that) either you have legal capacity to enter the Competition and agree to the Rules (i.e. that you are of sufficient age and mental capacity and are entitled to be legally bound in contract).
The Promoters reserve the right to disqualify any entrant if reasonable grounds exist to believe the entrant has breached any of these terms and conditions.
In the event that any entrant is disqualified from the Competition:
- The Promoters in its sole discretion may decide whether a replacement contestant should be selected. In this event, any further entrant will be selected on the same criteria as the original entrant and will be subject to these Rules;
- Property provided by the Promoters in accordance with the Rules shall be immediately returned.
Competition Entries
Only one entry per person is allowed.
Competition entries must be made via:
“Online Entry” – visit the visitTeesvalley website www.faceofteesvalley.co.uk, complete the entry form and upload a supporting video in accordance with the Guidance Notes. The deadline for an “Online Entry” is 31st August 2009.
“Promotional Events” – visit the TFM street team who will explain the procedure, film a video of you using their equipment and provide you with an application form that must be completed. Further details about Promotional Events are provided within the Guidance Notes.
The Promoter will moderate all application forms and videos. The Promoter reserves the right to reject or remove any Competition entry that they see as unfit without notifying the entrant.
All normal internet charges associated with the submission of an entry to the Competition shall be the entrant’s responsibility.
The Promoters cannot accept responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft, destruction, alteration of, or unauthorised access to entries, or entries lost or delayed whether or not arising during operation or transmission as a result of server functions, virus, bugs or other causes outside its control.
Entrants should note that unless stated otherwise, the Promoters are not obliged to provide a copy of any material constituting the whole of or a part of any Competition entries, including those consisting of artistic or other material.
Finalists
The Promoters, in accordance with criteria specified within the Guidance Notes, will select ten entrants (“Finalists”).
The Finalists will be notified of a publicity event held once they are shortlisted (Publicity Event. Return of any notification as undeliverable or failure to reply as specified in the notification within the time stated therein may result in disqualification and selection of an alternate entrant to ensure ten Finalists attend the Publicity Event. The names of all Finalists will be published on the visitTeesvalley website www.faceofteesvalley.co.uk and in the relevant press.
The Publicity Event includes travel expenses within the Tees Valley, photoshoot and lunch and refreshments. There is no cash alternative offered. Any further expenses incurred by any of the Finalists in the enjoyment of the Publicity Event shall be the entrant’s responsibility.
Two Finalists will be selected in accordance with criteria specified within the Guidance Notes and will be referred to as “Challengers”.
Challengers
The Challengers shall compete against one another in accordance with the Guidance Notes;
Each Challenger will receive a camcorder which will remain their property unless they are disqualified during the course of the competition. The camcorder must be used in accordance with the Guidance Notes;
Once the six months is complete, one Challenger will win a cash prize specified within the Guidance Notes.
Intellectual Property Rights
In consideration of visitTeesvalley agreeing to consider entrants to the Competition, each entrant hereby assigns to visitTeesvalley the complete copyright and all other rights derived from any entry, which shall be for the full period of copyright. visitTeesvalley shall be free to assign such rights to third parties.
Furthermore, any information submitted by you must be personal to and relate specifically to you. You hereby warrant that the information which you submit and/or distribute will not infringe the intellectual property, privacy or any other rights of any third party, and will not contain anything which is libellous, defamatory, obscene, indecent, harassing or threatening. If relevant, visitTeesvalley reserves the right, but not the obligation, to screen, filter and/or monitor information provided by you and to edit, refuse to distribute or remove the same.
Liability
The Promoters cannot accept any responsibility for any damage, loss, injury or disappointment suffered by any entrant entering the competition or as a result of accepting any prize. The Promoters are not responsible for any problems or technical malfunction of any telephone network or lines, computer on-line systems, servers, or providers, computer equipment, software failure of any email or entry to be received on account of technical problems or traffic congestion on the Internet, telephone lines or at any web site, or any combination thereof, including any injury or damage to entrant's or any other person's computer or mobile telephone related to or resulting from participation or downloading any materials in the Competition. Nothing shall exclude the Promoters liability for death or personal injury as a result of its negligence.
Data Protection and Publicity
Finalists may be requested to take part in promotional activity and the Promoters reserve the right to use the names and addresses of winners, their photographs and audio and/or visual recordings of them in any publicity.
Any personal data relating to entrants will be used solely in accordance with current UK data protection legislation and will not be disclosed to a third party without the individual's prior consent.
Jurisdiction
The Rules shall be interpreted and construed under the governing law of England & Wales and any disputes under these Rules shall be subject to the exclusive jurisdiction of the English Courts.
